Discussion List Terms of Use

The Discussion Lists are provided as a service of Vanguard Integrity Professionals - Nevada and its affiliates ("Vanguard"). This Discussion List allows Vanguard's customers to ask questions of their peers and other Vanguard users about products usage, configuration, etc.  This Discussion List also allows Vanguard to advertise some of its products and services to those who participate in this Discussion List.

I agree to provide true and correct information about myself on the Vanguard Discussion List Registration Form. I understand that my email address and any signatures that I have set up on my email program, identifying myself and/or my company, will be shown when I post to the Discussion List. When I send a message on this Discussion List it is automatically re-distributed to all of my fellow members. Messages are also kept in the archive.

I agree that Vanguard in its sole discretion may remove posts by me or terminate my account if it believes that I may have in any way violated the Terms of Use.

I agree to indemnify, defend and hold harmless Vanguard and its respective subsidiaries, affiliates, officers, owners, agents, employees, parents, insurers, successors or assigns from and against all loss, claims, demands, causes of action, liabilities, expenses, including reasonable attorney's fees and costs arising from any claim arising out of or resulting from, in whole or in part, (a) any breach of the Agreement by me or (b) any omission or act taken or committed by me.

Vanguard accepts no responsibility for the opinions and information posted on these lists by others. Vanguard disclaims all warranties with regard to information posted on the lists, whether posted by Vanguard or any third party; this disclaimer includes all implied warranties of merchantability and fitness. In no event shall Vanguard be liable for any special, indirect, punitive or consequential damages or any damages whatsoever resulting from loss of use, data or profits, arising out of or in connection with the use or performance of any information posted on these lists.

Vanguard reserves the right, at its discretion, to change, modify, add or remove all or part of the Terms of Use at any time. But if Vanguard makes changes, Vanguard will notify you by posting a message on the Service, or sending a message to you via e-mail.

By posting material, the posting party warrants and represents that it owns the copyright with respect to such material or has received permission from the copyright owner. In addition, the posting party grants Vanguard the non-exclusive right and license to display, copy, publish, distribute, transmit, print and use such information or other material.

The Terms of Use are governed by and construed in accordance with the laws of the State of Nevada and the intellectual property laws of the United States, and I agree to submit to the personal jurisdiction of the courts of the state of Nevada for any for any cause or action arising out of or relating to the Service or these Terms of Use.
